Distance Sales Agreement

This Distance Sales Agreement ("Agreement") governs the purchase of products through the Divista online store and is concluded electronically between the Seller and the Customer in accordance with the applicable laws of the Republic of Türkiye.

By placing an order through our website, the Customer confirms that they have read, understood, and accepted this Agreement.

2. Buyer Information

The Buyer's information consists of the personal and contact details provided during the checkout process.

The Buyer confirms that all information provided is accurate and complete.

3. Subject of the Agreement

This Agreement governs the sale and delivery of products purchased by the Buyer through the Divista online store.

The characteristics, quantity, price, payment method, and delivery details of the purchased products are those specified in the Buyer's order confirmation.

4. Products and Pricing

Product descriptions, prices, and availability are displayed on the website.

The Seller reserves the right to correct pricing or technical errors before accepting an order.

5. Payment

Payment must be successfully completed before the order is processed.

Payments are processed securely through authorized payment service providers.

The Seller does not store customers' payment card details.

6. Delivery

Orders are shipped to the delivery address provided by the Buyer during checkout.

Estimated delivery times are provided for informational purposes only and may vary depending on destination, customs procedures, weather conditions, public holidays, or courier services.

The Seller may use different shipping carriers depending on the destination and operational requirements.

7. Right of Withdrawal

Where applicable under mandatory consumer protection laws, the Buyer may exercise the right of withdrawal within 14 days from the date of receiving the goods without providing any reason.

To exercise this right, the Buyer must notify the Seller before the withdrawal period expires.

Returned products must comply with the conditions described in the Returns & Exchanges Policy.

Certain products may not be eligible for withdrawal where permitted by applicable law, including personalized or custom-made products.

8. Returns and Refunds

Returns and refunds are governed by the Divista Returns & Exchanges Policy and Refund Policy, which form an integral part of this Agreement.

9. Customer Responsibilities

The Buyer agrees to:

Provide accurate personal and delivery information.
Inspect the package upon delivery.
Notify the Seller promptly of any damaged, defective, or incorrect products.
Comply with all applicable laws regarding imported goods in the destination country.

10. Seller Responsibilities

The Seller agrees to:

Deliver products substantially as described on the website.
Process orders within a reasonable time.
Handle customer data in accordance with the Privacy Policy.
Process eligible returns and refunds in accordance with applicable law.

11. Customs and International Deliveries

International shipments may be subject to customs duties, VAT, import taxes, or other governmental charges imposed by the destination country.

Unless otherwise stated, these charges are the responsibility of the Buyer.

12. Force Majeure

The Seller shall not be liable for delays or failure to perform obligations caused by events beyond its reasonable control, including but not limited to natural disasters, war, strikes, transportation disruptions, governmental actions, pandemics, or customs delays.
